Has Bush Actually Destroyed the Noble Experiment?
President Bush, not content with dragging this country into an illegal and immoral war, is quietly expanding presidential authority in ways others never imagined. Bush claims he has the authority to ignore laws Congress has passed when it is in confict with his warped interpretation of the Constitution. He claims that he can ignore such laws as the following: Military rules and regulationAffirmative-action provisionsRequirements that Congress be told about immigration services problemsWhistle blower protections for nuclear regulatory officials and safeguards against interference in federally funded research Most legal scholars insist the Bush's attempts to bypass laws means a concerted effort to expand his power at the expense of Congress. Obviously, this upsets the balance of power between the branches of government. We must remember that the Constitution is clear in assigning to Congress the "power to write the laws and to the president that the laws be faithfully executed." However, this president has repeatedly declared that he does not need to execute a law he feels is unconstitutional.
Members of his administration actually believe that just because Bush reserves the right to disobey a law does not mean that he is not enforcing it. Huh? Is this the new Bushspeak? He adds that he is asserting his belief that a certain requirement encoraches on presidential power. But recent disclosures of domestic syping requireing warrants to tap the phones of U.S. citizens have been ignored. Most legal scholars belive that Bush's theory abuses presidential power and that he is boldly stealing Congressional law making roles for himself. Check some of the laws this president feels he can igonre: Challenging new laws that ban torutureA requirement that he give detailed reports to Congress on how he is using the Patriot Act Bush's people cite Bush's position that he could ingore provisions of the Patriot Act because he was following a practice that "has been used for serval adminstrations" and that "the president will faithfully execute the law in a manner that is consistent with the Constitution."
Bush is the first president in recent American history who has never vetoed a bill, giving Congress no chance to override his judgments. For after the 2000 court appointed president signs a bill, he files a signing statements. These are official documents in which he lays out his interpretation for the federal bueauracracy to follow when implementing a new law.
He repeatedly has stated that he believes the Constitution gives him the right to ignore many sections of the bills, appending such statements to more than one of every 10 bills he signs. With this warped interpretation of the American Constitution, American democracy is dealt yet another blow by this power crazed administration. Like the Old Liberal has said, "I knew he was stupid. I knew he was incompetent, but I didn't know how dangerous he could be." Certainly his so-called president represents a danger to the American system of government--one that is based upon checks and balances.
